The topic of the new decent vacation reform continues on the radar of thousands of people, after it was approved and reflected in the Official Gazette of the Federation (DOF) on December 27, 2022 and which will enter into force on January 1, 2023.

And there are some doubts such as how many vacation days correspond to me if I have 4 or 5 years in the company?, usually arise, since the decree of the new law says that from this year the vacation period will increase, according to the time that each employee has in the company.

That is to say, those people who, for example, have completed one year in the company for which they provide their services, from this year on their vacations will increase by 6 to 12 dayswhich may be used continuously or in parts.

Vacations may be requested by the employee in the period that he requires, but they must also be respected by mutual agreement between the employer and the collaborator.

For its part, according to the decree endorsed by the Ministry of Labor and Social Welfare, for a worker with 4 years in the company you can get up to 18 days Rest.

While collaborators who have up to 5 yearswill be entitled to a total of 20 days continuous vacation.

The vacation period will be granted depending on the seniority of each of the workers, since they will increase two days year after year until reaching five years (20 days off).

From the sixth year of work in the companythe vacation period will increase two more days for every five days of service.

It must be remembered that the time in advance to request vacations will depend on the policies, calendar, and contract that the company has with the employee. The essential requirement is that they must be agreed upon and granted within the six months following the completion of the year of service.

Regarding the issue, the President of Mexico, Andrés Manuel López Obrador, reaffirmed the importance of the vacation period for employees, since he believed that it is the best for both the organization and the company.
